Introduction

This Acceptable Use Policy ("Policy") outlines the rules and guidelines for using the 365 Omni platform ("Service"). By accessing or using the Service, you agree to comply with this Policy. We reserve the right to investigate and take appropriate action against any violation, including suspending or terminating your account.

This Policy applies to all users of the platform, including account owners, agents, administrators, and any third parties accessing the Service on behalf of a customer.

Prohibited Activities

You may not use the Service to engage in, facilitate, or promote any of the following activities:

Spam and Unsolicited Communications

You may not use the Service to send unsolicited bulk messages, spam, or commercial advertisements through any connected channel. This includes:

  • Sending mass messages to users who have not expressly consented to receive communications
  • Using automated tools to send messages at a rate that exceeds reasonable human behavior
  • Distributing chain messages, pyramid schemes, or deceptive promotional content
  • Violating the WhatsApp Business API messaging policies, including prohibited use of template messages for marketing without opt-in
  • Violating Meta's Platform Terms or Messenger API usage guidelines regarding spam

Illegal Content and Activities

You may not use the Service to transmit, store, or facilitate any illegal content or activity. This includes:

  • Content that violates any applicable law or regulation
  • Child sexual abuse material (CSAM) or any content involving minors in inappropriate contexts
  • Content that promotes or facilitates illegal drugs, weapons, or human trafficking
  • Unauthorized access to systems, data breaches, or hacking tools
  • Fraudulent schemes, including phishing, identity theft, or financial scams

Abuse of the Platform

You may not abuse the Service in any manner that impairs our ability to provide it to other customers. This includes:

  • Attempting to circumvent rate limits, access controls, or security measures
  • Interfering with the proper functioning of the Service, including introducing malware or viruses
  • Engaging in denial-of-service (DoS) attacks or other disruptive activities
  • Creating multiple accounts to circumvent restrictions or trial limitations
  • Using the Service in a way that negatively impacts other customers' experience

Harassment and Harmful Content

You may not use the Service to transmit or facilitate any harassing, threatening, or harmful content. This includes:

  • Hate speech, discriminatory content, or incitement to violence
  • Harassment, bullying, or intimidation of any individual or group
  • Explicit, pornographic, or sexually explicit content where prohibited by channel policies
  • Content that promotes self-harm, suicide, or eating disorders
  • Deepfake content or non-consensual intimate imagery

Malware and Harmful Code

You may not use the Service to distribute or host malicious software or content. This includes:

  • Viruses, worms, trojans, ransomware, or any other malicious code
  • Links to malware distribution sites or phishing pages
  • Cryptocurrency miners, botnets, or command-and-control infrastructure
  • Exploit kits or tools designed to compromise systems

Fraud and Deception

You may not use the Service to engage in fraudulent or deceptive practices. This includes:

  • Impersonating individuals, organizations, or brands without authorization
  • Creating fake accounts or bots designed to deceive users
  • Misrepresenting your identity, affiliation, or the purpose of your communications
  • Using the Service to conduct financial scams, including advance-fee fraud or romance scams
  • False advertising or deceptive marketing practices

API Abuse

Use of the 365 Omni API is subject to the following additional restrictions:

  • Rate Limits: You must respect documented API rate limits. Excessive API calls that degrade service performance may result in throttling or temporary suspension.
  • Unusual Traffic Patterns: API usage that deviates significantly from normal human behavior patterns may be flagged and investigated.
  • Webhook Abuse: Webhook endpoints must respond promptly. Repeated failures or timeouts may result in delivery suspension.
  • Data Scraping: Automated scraping of data from the platform beyond what is necessary for normal integration is prohibited.
  • Unapproved Use: Using the API for purposes not documented in our API reference without prior approval is prohibited.

Channel-Specific Policies

When using the Service to connect third-party channels, you must comply with the respective platform's policies:

  • WhatsApp Business API: You must comply with Meta's WhatsApp Business API Terms, WhatsApp Business Messaging Policy, and applicable telecom regulations. This includes obtaining proper opt-in consent before sending messages, using approved message templates, and adhering to quality rating requirements.
  • Facebook Messenger: You must comply with Meta's Platform Terms, Messenger Platform Policy, and Community Standards. This includes respecting user privacy, not sending prohibited content, and using approved login flows.
  • Instagram Graph API: You must comply with Meta's Instagram Platform Policy, including restrictions on automated interactions, content moderation requirements, and user data handling.
  • LinkedIn API: You must comply with LinkedIn's API Terms of Use and Developer Agreement, including restrictions on automated messaging and data collection.
  • X (Twitter) API: You must comply with X's Developer Agreement and Policy, including rate limits, content restrictions, and automation rules.

Violations of channel-specific policies may result in both action by the channel provider and suspension of your 365 Omni account.

Content Monitoring and Enforcement

We reserve the right, but do not assume the obligation, to monitor the Service for violations of this Policy. Our enforcement actions may include:

  • Issuing warnings for minor or first-time violations
  • Removing or disabling access to prohibited content
  • Temporarily suspending access to the Service pending investigation
  • Permanently terminating accounts for serious or repeat violations
  • Reporting illegal activity to appropriate law enforcement authorities

We may update this Policy from time to time. Continued use of the Service after changes constitutes acceptance of the updated Policy.

Violations

If we become aware of a potential violation of this Policy, we will investigate the matter. Depending on the severity and frequency of the violation, we may take one or more of the following actions:

  • Warning: We may issue a written warning asking you to cease the violating activity within a specified timeframe.
  • Content Removal: We may remove specific content that violates this Policy without prior notice.
  • Feature Restriction: We may restrict access to specific features of the Service (e.g., disabling API access or channel integrations).
  • Temporary Suspension: We may temporarily suspend your account while we investigate the violation.
  • Permanent Termination: We may permanently terminate your account for severe or repeated violations. Upon termination, all data associated with your account will be deleted in accordance with our Data Retention Policy.
  • Legal Action: We may refer violations to law enforcement and cooperate in any resulting investigation or prosecution.

You may appeal enforcement actions by contacting our compliance team at compliance@365omni.com. Appeals will be reviewed within 10 business days.

Reporting Violations

If you become aware of any violation of this Acceptable Use Policy, please report it to us immediately. We encourage users, customers, and third parties to report any content or behavior that appears to violate this Policy.

To report a violation, please provide the following information:

  • Your name and contact information (optional for anonymous reports)
  • The specific content or behavior you believe violates this Policy
  • The location of the content (e.g., workspace name, user, channel, message ID)
  • The date and time the violation occurred
  • Any supporting evidence or documentation

We acknowledge receipt of all reports within 48 hours and will take appropriate action. We maintain the confidentiality of reporters to the extent permitted by law.

Consequences of Violation

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your access to the Service. We reserve the right to terminate your account without prior notice if, in our sole discretion, your use of the Service poses a risk to other users, third parties, or the integrity of the platform.

In the event of termination due to a Policy violation, you will not be entitled to a refund of any pre-paid fees. We may also pursue legal remedies, including injunctive relief and damages, for violations that cause harm to us or others.

We reserve the right to cooperate with law enforcement authorities in investigating and prosecuting illegal activities conducted through the Service.
